1. This Website
1.1 Your use of this website and any services or sales contained within constitutes acceptance of these Terms & Conditions.
2. Security and Privacy
2.1.1 The final payment stage where you enter your card details is managed externally to our site by: PayPal. This offers a huge additional level of protection for you, given that PayPal can offer the highest level of security.
2.1.2 At no point in time does Obelisque Design store your credit card number. This is encrypted and hidden from our view by the systems at PayPal. You will see the padlock icon on the bottom of your screen and the new Internet address in your browser. You can verify the identity and status of the site by clicking on the padlock icon on your browser.
2.1.3 Data relating to your order, your payment card details will be securely transmitted from your screen as you type this in, to the PayPal secure server in an 128-bit (the maximum) encrypted format. This information is then decrypted only once it has safely been stored on the PayPal secure server. PayPal will then verify your details with your bank/credit card company (in an encrypted format) and attempt to process the transaction. If there are any errors, for example if you enter a wrong number, or your address doesn’t match the card, you will be asked to reenter this information. If the transaction is successful you will receive a digital receipt from PayPal and an order confirmation from us. Both will be sent to your specified email address.
2.2 Obelisque Design takes the security and privacy of your data very seriously.
2.3 You should always check that the contact information you provide is correct before proceeding to payment.
2.4 Our website is only intended for use by adults. Adults may purchase products for children as long as the products purchased are intended by the manufacturer for use by children.
3.1 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at anytime up to the shipment of that order and any related items.
3.2 We reserve the right to alter all product pricing without notice.
3.3 Title in any products ordered from us does not pass to you, the purchaser until we have received and processed a valid payment, and that payment has been made into our own bank account.
3.4 The prices displayed on our website are in British pounds (sterling) and include VAT (if applicable).
4. Acceptance of Your Order
4.1 When you place an order you will automatically receive a confirmation email from us to confirm your order. Your order constitutes an offer made to us to purchase the goods specified in the order.
4.2 Your offer is only accepted once we have received payment.
4.3 Product items not dispatched are not included in the order and contract between you and us.
4.4 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
4.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.
4.6 Once the payment has been received, under the distance selling regulations, you have 14 days in which to cancel your order and receive a full refund. Specialist orders such as bespoke and made to order items will result in a 10% cancellation charge based on the entire cost of the order.
4.7 A deposit of 50% is required for all bespoke and made to order items at the time of ordering. If a cancellation is made anytime after the acceptance of the order then a above 4.6 clause is applicable.
5.1 All orders received by us are shipped subject to availability.
- Our estimated delivery times are as stated in the product details.
- Delivery is included in the product price unless otherwise stated.
- If for any reason there is a delay we will keep the customer informed of expected delivery times.
5.2 TH-9 Transport tubes are for delivery purposes only and do not form part of the warranty. NO liability can be accepted for the tube if damaged.
5.3 We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control. If such disruption occurs you will be offered delivery via an alternative delivery or fulfillment company or a full refund.
6. Returns Policy
6.1 All returns must first be requested in writing. Full contact details are available here. You have 14 working days* following the day of receipt to request authorisation for a return.
* All business to business transactions, return postage and insurance is the buyer’s responsibility.

Bespoke items are made to your individual requirements and are therefore not returnable unless faulty in which case a repair or replacement will be offered free of charge.
6.2 As stated above notification of cancellation must be in writing, a telephone call is not a valid cancellation.
6.3 Please observe the following procedure for all returns to us:
6.3.1 Please contact us to authorise your return.
6.3.2 If you are returning your product because it is defective, please state the defect or defects. Returns that are claimed to be defective will be inspected thoroughly if no defect is evident or if there are signs of misuse or manhandling then no refund will be issued and it will be the purchasers responsibility to collect or arrange collection of the item.
6.3.3 Repackage the product in its original packaging (please use clear tape to reseal any opened bags), including any accessories, brochures, manuals, guarantees or warranties that came with the product. Goods should be returned in a re-saleable and complete condition. Unfortunately we will be unable to issue credit where the product is in an incomplete state or shows evidence of use beyond necessary handling.
6.4 If the original packaging surrounding the product has been damaged or destroyed we will only issue a refund if the product is being returned due to a defect. If the original packaging of a defective product has been damaged or destroyed you should ensure that the returned product is adequately packed for shipment back to us.
6.5 Where a return is lost or stolen in transit to us, you should claim compensation from the company that shipped the return.
6.6 We will also credit the cost of standard or recorded postage incurred returning a product, if incorrectly sent by us.
6.7 After 6 months it is your responsibility to return faulty goods to us at your own expense. It is also your responsibility to obtain tracking numbers and to arrange adequate insurance to cover the cost of damage or loss of the item in transit.
7.1 We endeavor to respond to all customer complaints or queries within three working days. We aim to offer a timely and helpful response to all complaints and strive to achieve total customer satisfaction.
7.2 If you have a complaint please email us stating as much detail as possible in order for us to resolve the issue within a satisfactory timescale, you will be kept fully informed of the status of your complaint.
8. Faulty Products
Where a Customer experiences a fault with a product it can be returned to Obelisque Design , subject to our Returns Policy above.
9.0 All Rotabend products come with a 2 year RTB ( Return to Base) limited warranty to include the following items only. Faulty equipment due to manufacture/assembly, premature failure of electrical or mechanical components.
What is not included (Exclusions) Damage or faults caused by misuse, neglect of basic maintenance, Scratches ,dents marks from general wear and tear. Failure to comply with the safety instructions enclosed with the equipment. Any neon or led indicators. Leads or external cables. Nichrome wires (if applicable). Damage or injury to a third party or property caused by misuse of the equipment.
All equipment must be PAT tested after 12 months of purchase, failure to do so will invalidate any remaining warranty. All warranties will be void if the equipment is modiﬁed or opened without prior consent by Rotabend. A warranty will be honoured if none of the above exclusions have been applied and the conditions below have been met.
For indoor use only, do not expose to water,damp or humid conditions. Make sure the mains power supply the unit is connected to is the correct voltage for the unit. Make sure that the supply is properly earthed. Do not open the appliance (DANGER High Voltage risk of electric shock.) Keep all loose fitting clothes, ties etc away from the unit as well as jewellery, watches & hair. CAUTION The appliance becomes HOT during operation keep all combustible materials away. wear protective gloves & clothing. Make sure the appliance sits on a heat resistant surface. DO NOT PLACE on vinyl, carpeted, combustible or polished/laquered wooden floors.
DO NOT allow children or untrained staff to operate the appliance. DO NOT use the appliance if any of the cables are damaged or worn. DO NOT use the unit for any other purpose than what it is intended for. DO NOT pick up the appliance by the cables. DO NOT obstruct any ventilation holes. DO NOT leave the unit switched on while not in use. DO NOT leave plastics or any other material on the beam heater for excessive times. DO NOT touch or let any other substances come into contact with the heating element. ALWAYS allow the appliance to cool down adequately before packing away Keep the heating beams clean and free of dust and debris. Always remove any debris from the heating beam channel immediately but ONLY after the unit has been switched off and the element has cooled down.
NEVER leave the unit unattended while switched on. Do not adapt the heater in any way, this can damage the unit and may cause personal injury.
9.1 Our products have a 12 months warranty against manufacturing defects.
9.2 Any goods which are subject to a warranty claim should be returned to Obelisque Design for inspection.
9.2.1 Please contact us to authorise your return.
9.2.2 Upon inspection Obelisque Design will within six months of purchase repair, replace or refund the original cost of the defective unit as we see fit .
9.3 Warranty does not cover accidental or deliberate damage, acts of god, damage incurred by incorrect use or not following any specific instructions supplied with the goods. The goods must not be modified or repaired by anyone without our prior approval.
9.4 Any products that have not failed due to manufacturing defect, will be repaired at the cost of the customer. Obelisque Design reserve judgment on this and our decision is final.
9.5 Carriage costs for the return of goods to Obelisque Design will be the responsibility of the customer.
9.6 Warranty does not cover the incorrect purchase of our products.
9.7 The warranty will become invalid if the products have not been used for the purpose they were designed for, modified or mistreated in anyway.
9.8 Business to business sales are not covered by the same conditions as consumer warranties, please contact us for full details.
10.1 All content, databases, graphics, buttons, icons, logos, layouts and look & feel are the copyright of Obelisque Design , unless expressly acknowledged as otherwise.
10.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.
Other Legal Matters
11.1 Obelisque Design , grants you a license to access the content, information and services contained within our website for personal use only.
11.2 This license allows you to download and cache (using your browser) individual pages from our website.
11.3 This license does not allow you to download and modify individual pages or substantial parts of our website nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.
11.4 Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.
11.5 Our website cannot be placed within the frame-set of another site.
11.6 Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website. Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.
11.7 The restriction on “deep linking” does not apply to affiliate partners who wish to send customers directly to a particular page or product in order to increase their affiliate sales.
The foregoing paragraphs, sub-paragraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.
Failure by Obelisque Design to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless we acknowledge the waiver in writing.
14. Entire Terms & Conditions
These Terms & Conditions set out the entire agreement and understanding between you and Obelisque Design. We reserve the right to change these Terms & Conditions at any time, without giving notice to you.
15. Events outside our control
Obelisque Design , shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.
These Terms & Conditions shall be interpreted, construed and enforced in accordance with UK law and shall be subject to the exclusive jurisdiction of UK Courts.
Nothing in these terms and conditions affects your statutory consumer rights.
17. Distributors and Agents
All Rotabend equipment and machinery is built to the highest standards set out by the relevant authorities. A distributor should satisfy themselves that the product is suitable for distribution in the country they intend to distribute Rotabend products. All machinery is supplied with the appropriate documentation and service guides which must be supplied to the end user. No alterations or customisation to the machinery or its documentation is allowed without prior written consent from Rotabend. Any damage ( including damage in transit by a courier or third party ) caused to equipment or machinery after it has been delivered and signed for by the distributor or selling agents is the sole responsibility of the distributor or selling agents. All end user returns must be returned to the distributor or selling agents for collection by Rotabend unless prior written consent is issued by Rotabend or is outside the U.K. For all distributors or selling agents outside the U.K. All repairs and servicing must be performed in house or by a local qualified repair agents that have written consent from Rotabend to do so. Consent must be obtained from Rotabend for any repairs or servicing prior to commencement. ONLY parts obtained from Rotabend or its suppliers must be used no alternatives parts should be supplemented. A full technical report should be prepared and submitted to Rotabend before a repair commences. Rotabend will pay for repairs by a distributor or repair agent for faulty items that come within the terms of the warranty period up to a total of £50.00 + parts for any repair. Only one repair will be allowed per Machine or equipment. Once a repair has been completed it is the responsibility of the repairer to guarantee their own work ,No responsibility can be brought against Rotabend for faulty repairs. Any shortages or faulty items must be reported to Rotabend in writing within a reasonable time.
